Terms and Conditions

ORDERS SUBMITTED TO WWW.GARDENZONE.CO.UK (“THE WEBSITE”) ARE SUBJECT TO THE TERMS AND CONDITIONS (THE “WEBSITE TERMS”) SET OUT BELOW.

   

Submitting an order to the website indicates you wish to enter into a contract for the purchase of the goods set out in your order with the supplier/s of those goods (not Gardenzone Ltd) through the website 

   

The Website Terms do not affect your statutory rights

   

At present goods can only be supplied to addresses in the United Kingdom (Please e-mail info@gardenzone.co.uk for further information)

   

PLEASE READ CAREFULLY THE WEBSITE TERMS SET OUT BELOW AND INDICATE YOUR ACCEPTANCE BY CLICKING WHERE INDICATED AT THE BOTTOM OF THE PAGE

   

1. THE CONTRACT

   

You will place an order for Goods by submitting a completed order form on the Website. We will confirm receipt of your order by e-mail and send your order to the Supplier to fulfil

   

At all times we only act as agent for the Supplier, which means that although we make the Contract on the Supplier’s behalf, you contract directly with the Supplier. The name of the Supplier of the Goods appear alongside the description of the Goods on the Website

   

The Contract will not be formed until we notify you by e-mail that your order has been accepted

   

   

You are responsible for checking the accuracy of your order before you submit it and we advise you to print out a copy of these Website terms and conditions at the time you submit the order

   

2. PRICE

   

The price of the Goods is the price quoted on the Website when you place your order. It includes delivery costs and any applicable Value Added Tax

   

Delivery costs are quoted on the Website and you should ensure that you are aware of them before you submit your order. Please check the delivery costs before proceeding with your order

   

3. PAYMENT

    

Payment will be deducted from your credit card on the date your order is accepted. We accept those credit cards listed on the Website on that date.

You must be authorised to use the credit card from which payment is made

   

 All credit card transactions are dealt within a secure environment.

   

4. DELIVERY

   

The Supplier is responsible for delivering the Goods to you and will endeavour to meet any delivery requirements specified in your order (if applicable) that are made in accordance with the delivery restrictions detailed on the Website

   

Time for delivery shall not be of the essence of the Contract

   

If you do not take delivery of the Goods or give adequate delivery instructions the Supplier may store the Goods until successful delivery and charge you the reasonable costs (including insurance) of storage. The Supplier shall not owe you any duty of care in relation to the storage of the Goods and shall not be liable for any loss, damage or deterioration of the Goods during storage

   

If there is a short delivery you must inform us by e-mail within 7 working days from the date of delivery. If you do not do so the Supplier shall not be responsible for any loss or damage suffered by you as a result of the short delivery. If there is short delivery the Supplier’s liability shall in any case be limited to the price of the Goods not delivered

   

5. RISK AND TITLE

   

Risk of damage or loss of the Goods will pass to you on delivery or, if you fail to take delivery of the Goods, the time when the Supplier (either directly or through a delivery service) has tried to deliver the Goods

   

Title in the Goods will pass to you on successful delivery of the Goods

   

6. WARRANTY AND LIABILITY

   

The Supplier (not Gardenzone limited) is responsible for the fulfilment of the Contract and any problems which may arise with the Goods.

   

You should contact us if any problems occur with the Goods or delivery of them.

   

Nothing in this clause shall exclude the Supplier’s liability for death or personal injury caused by its negligence or your statutory rights as a consumer

   

The  Supplier warrants that the Goods will comply with their description and be of satisfactory quality. Please note that the limitations of displaying goods on the Internet mean that the colour of the products on the Website may vary slightly from the Goods supplied to you under the Contract

   

In addition to your statutory rights, if the Supplier is in breach of this warranty and the breach occurs within 3 months from the date the Goods were delivered to you under this Contract, the Supplier may at its sole option:

   

·        repair the Goods

   

·        replace all or any part of the defective Goods; or

   

·        refund the price of those Goods which are defective

   

The warranty given in this clause is in addition to any other warranty or guarantee (whether advertised on the Website or otherwise) given by the Supplier for the Goods

  

The returns policy of the Supplier with whom you have entered into a contract through the Website is available on request.

   

7. GENERAL

   

If any provision of these Website Terms is held by any competent authority to be unlawful, invalid or unenforceable in whole or in part then the validity of the other provisions of these Website Terms and the remainder of the provision in question shall not be affected thereby and shall continue to be valid and enforceable to the fullest extent permitted by law

   

The Contract shall be governed by English law and you submit to the exclusive jurisdiction of the English courts if there are any disputes relating to the Contract

   

No third party rights or benefits under the Contracts (Rights of Third Parties) Act 1999 are created or intended to be created under the Contract

   

Failure or neglect by the Supplier to enforce at any time any of these Website Terms shall not be a waiver of the Supplier’s rights and it shall not affect the validity of the whole or any part of these Website Terms or prejudice the Supplier’s right to take subsequent action

   

These Website Terms shall govern the Contract to the exclusion of any other terms and conditions

   

We may alter these Website Terms from time to time without notice. You agree that any purchase from the Website on any future visit to it shall be governed by these Website terms as amended at the date of each visit

   

8. DEFINITIONS

   

In these Website Terms unless the context otherwise requires the following definitions are used:

   

We, us and our  GardenZone Ltd, whose registered office is at Butts Farm Business Park Poulton Cirencester Gloucestershire GL7 5HY

   

I, you and your the person accessing the Website to order Goods

   

the “Contract” the contract (subject to the Website Terms) which you make with the Supplier on the basis set out in clause 1 above     

   

the “Goods” the item/s you order from the Website

   

the “Supplier” any sole trader, partnership, company or other organisation who contracts to sell you the Goods under this Contract
